Here's how it works:

Imperials must obey Imperial Law. The Arbiters are entirely separate from this, and being flagged in and of itself does not matter.

Imperial Law states that for the promotion of Order, attacks are not to be made in a protected city, EXCEPT when Imperial Law stipulates that such shall be permitted. Exceptions are: attacking and slaying anathema, and attacking and slaying one who holds an Item of Power that belongs to the Emperor.

It's not that complex, really. It doesn't matter if you're "caught" or not by the Arbiters, as they're only pawns irrelevant to Imperial Law itself--if you attack in town and your foe is neither anathema nor the bearer of the Codex, sapling, etc, then you are violating Imperial Law and will be anathemized. Furthermore, if you kill an anathema in town and get flagged for it, all the more power to you. Breaking Arbiter Law is not a bad thing. Breaking Imperial Law is. It happens to be that the two coincide in most cases, but *not* in all cases.
