What I see is the one backstab, yes it hurt like hell, but the round of combat you parried or dodge every hit. Next you were stupid and tried to impale. If you miss with an impale, it is a free attack, much like missing with a spell. Impaling a moving target is a lot harder to hit with now days (I would say it hits less than 50% when mastered).

In theory, you could have fled if you unbind and flee. A small chance, but more of a chance of living than staying and trying to impale.

And do not complain about thieves being over powered. They get their ass handed to them alot by warriors.
