YES!

Alright, let's look at the reaction of each of the three possible align/ethos combinations for a Maran-type (LG, NG, CG) to this situation.

LG: That fiend's belongings are in the pit. If he reclaims them, he will be able to do greater harm to the cause of the Light. However, to take them would be illegal, and while it might do good in the short term, if the laws are not respected, then all the good people of Thera will suffer from the lack. Damned fiend, he shall feel the wrath of the righteous.... but not right now.

NG: That fiend's belongings are in the pit. If he reclaims them, he will be able to do greater harm to the cause of the Light. Yes, it would be illegal to take them, but when the laws would protect such tainted souls, righteousness prevails. get all pit

The line of reasoning that so many people seem to be following would remove the distinction between LG and NG. It exists for a reason.
