If the binder is not with the servitor, the servitor cannot be attacked by players out of range of the binder. True. However, the servitor also cannot attack players out of range in this same case. I think I'd consider that a benefit. Remove the range restriction and there would be a flood of complaints regarding servitors that were killing out of range.

Also, I'm curious what your objection is regarding the massive giant. If the binder stayed at the giant, you couldn't harm him OR the servitor anyway (if you were out of range). The servitor can't take back cabal items and certainly can't take an enemy cabal item without the binder present.
