My recollection of his take on the issue (I think it was initially regarding Kosedran) is that once other mortals start learning of the behavior, then the character opens himself up to punishment for further such acts, even if those later acts are not witnessed by anyone other than the victim.

Standards also differ, I'm sure. A Sphere Deception character with role entries documenting his behavior isn't going to get smacked down just because an Imm is snooping him, whereas a Sphere Order Imperial who kills people in town without hesitation probably would.

Or am I wrong in my recollection?
